1. general
the terms and regulations for using and participating at the best shop onlineshop are established in these conditions. by using the site the user agrees to the written terms.
this website is in property of sumi ha, best shop berlin and is seated in berlin. all content (design, structure, selection, coordination, expression and arrangement of such content) is owned, controlled or licensed by sumi ha.
sumi ha reserves the right, at its sole discretion, to change, modify, add or remove parts of these terms of use at any time. it is your responsibility to check these terms of use periodically for changes. your continued use of the site following the posting of changes will mean that you accept and agree to the changes.
while you comply with the terms of using the site, the best shop online grants you a personal, non-exclusive, non-transferable, limited privilige to enter and use the site.
the user will have the chance to buy the items and clothes which are also available at the best shop, alte schšnhauser str. 6, 10119 berlin.
best shop reserves the right of errors caused by type faults or unintentional errors in the product information on our web pages. we cannot guarantee our pictures to display all colors with 100% accuracy.

there is no fee of using the site.
3. how to shop
you will be guided on the site. if you decided for one item you have to put it into the basket and follow the instructions.
4. payment
all merchandise items remain the property of best shop until full payment is received at the mentioned account.
all fraud will be given to the police. in case of fraud or suspected fraud best shop has the right to cancel the order.
all prices are in euro and are included vat. customers from outside of europe will be charged exklusive vat minimum order is 35 euros.
extra charges within foreign payments have to be paid by the customer.
the delivery costs will be extra and mentioned within your order at the site. Under „shipping“ you´ll find the exact costs of your delivery.
the payment will be through our paymentsytem offered at the site. we do not take orders at the phone. do not pay any prepayment. we are not responsible for cash, checks or stamps which are sent via post or mail.
for payments we accept visa and mastercard.
5. delivery
all packages are shipped from berlin, germany by ups. please see prices under shippment terms. your order will be delivered to the adress you supply. it is also possible to pick up your order at the local ups pick-up point, which will also be the option if you are not at home the first two times the courier tries to deliver at your door. the courier will leave you information about the address to the local ups pick-up point.
normal delivery time is 7-10 days. the delivery time may vary within the product range. in your order confirmation you will find information on the delivery time of your order. if by any reason the delivery time will differ from the time promised, we will contact you as soon as possible.
we will charge Ű15 if you at delivery refuse to sign for the ordered package or if its not picked up at the pick-up point.
all shipped packages are insured. if the package and/or the content is damaged upon arrival, please report that to the courier when you receive it. if you notice any damages when you unpack, please contact us directely.
if there will be any extra customs charges, the buyer is responsible for it and has to pay the extra fee.
6. right of withdrawel
within germany you have the right of withdrawel the sale contract within 2 weeks after recieving the goods. the disclaimer has to be in written form or by sending it back to best shop, alte schšnhauser str. 6, 10119 berlin within the time limit. the withdrawel is not possible for customized or reduced items as well as any illustrated items like magazines or books and any welt items. labels are not allowed to be removed or damaged. the ordered items have to be in unworn condition. by sending back used or damaged items we have the right to reduce the refund money. the return has to be in original package or any comparable protective package.
returns of items up to 40 euros, the customer has to pay the delivery costs. return delivery has to be assured. returned items over 40 euros are fetched up by our ups service, otherwise we can«t be charged for the costs.
in case of correct withdrawel we recompense all already made payments after the returned items recieved us. the time of payback will be within 30 days.
customers from outside of germany have to contact us within 5 days after recieving the item to make a spezial agreement.
7. privacy
to order you have to open an account. you are entirely responsible for maintaining the confidentiality of your account information, including your password, and for any and all activity that occurs under your account. you agree to notify sumi ha immediately of any unauthorized use of your account or password, or any other breach of security. however, you may be held liable for losses incurred by sumi ha or any other user of or visitor to the site due to someone else using your password or account.
you may not use anyone elseŐs password or account at any time without the express permission and consent of the holder of that password or account. sumi ha cannot and will not be liable for any loss or damage arising from your failure to comply with these obligations.
the privacy policy applies to use of this site, and its terms are made a part of these terms of use by this reference. additionally, by using the site, you acknowledge and agree that internet transmissions are never completely private or secure. you understand that any message or information you send to the site may be read or intercepted by others, even if there is a special notice that a particular transmission (for example, credit card information) is encrypted.
8. guarantee
the guarantee averages 24 months after sent out the item. the reclamation is only possible with the correct invoice and date of purchase. before sending back to us contact us by email or phone to make an agreement. the item has to be sent back with a copy of the original invoice to

the guarantee is not extended to normal wearout or not right use of the item. the guarantee is expired if the customer changes the bought item.
9. liability
best shop, sumi ha, is not liable for possible damages or disadvantages which may occur by using the ordered items, especially when items are used in faulty way. compensation is excluded unless the damage is caused intentional or an act of gross negligence. sumi ha cannot ensure that any files or other data you download from the site will be free of viruses or contamination or destructive features.
10. applicable law
all deliveries only apply to german law.
11. copyright
the webshop and pictures within are copyrighted according to german copyright law. announcement, duplication, circulation or imitation of the design are just allowed after written permission by sumi ha.
